Abstract

The research with the title "Construction of Intentional Homicide in the Vital Organs Study 692k/PID/2015" is motivated by an inconsistency between the Supreme Court's Decision which uses jurisprudence on the fulfillment of intentional elements and the District Court's Decision with the Decision of article 351 Paragraph 1 of the Law Criminal for murder. This study aims to analyze intentional acts in the killing of vital organs using sharp weapons as stipulated in Judge Jurisprudence No. 1/Yur/Pid/2015 concerning killing in vital organs. This research is a normative research that uses a conceptual approach, a statutory approach, and a case approach. Based on the research approach mentioned above, the research results obtained are intentional acts in killing in the vital organs are regulated not using Article 351 paragraph 3 of the Criminal Code contained in the decision of the court of first instance or appellate level but the constraints at the Supreme Court level with jurisprudential decision No. 1/Yur /Pid/2015 regarding murder with intentional injuring vital organs with the intent to kill.
