Abstract

This thesis discusses the Legal Protection of Debtors Against Misbruik Van Omsandigheden in Agreements. The formulation of the problem contained in this thesis is what are the legal consequences if there is an abuse of circumstances (Misbruik van Omstandigheden) in an agreement and what are the efforts of the debtor if there is an abuse of circumstances (Misbruik van Omstandigheden) in the agreement he made. The research method used is a normative research method with a statutory, conceptual and case approach that is related to this research. The results of this research show that an agreement is made with the free will of both parties, thereby violating the rules of agreement according to Article 1320 of the Civil Code, namely agreement between the parties as per the rules of Article 1449 of the Civil Code which provides an opportunity to cancel the agreement for parties who experience mistakes or coercion. and fraud. then according to the interpretation of the rules of Article 1449 of he Ciil Code. the party experiencing abuse of circumstances (misbruk ran omstandigheden) has the right to apply for cancellation and the Debtor's efforts if there is an abuse of circumstances (Misbruk van Omstandigheden) in the agreement he made as per the rules of Article 1267 of the Civil Code. stating that the party against Whoever does not fulfill le agreement may have the right, if this can still be done. to force the other party to fulfill he agreement or he will demand cancellation of the agreement along with compensation for costs, losses and interest.
